Atelier Merkando is operated by Merkando Solutions UG (haftungsbeschränkt), Wilhelmstraße 19, 35392 Gießen, Germany, registered with the Amtsgericht Gießen, HRB 12167, VAT ID: DE455233158, Managing Director: Carsten Marx (hereinafter "we", "us", "our").
§ 1 Scope
These Terms and Conditions apply to all contracts concluded via our online shop atelier-merkando.com between us and consumers within the meaning of § 13 BGB. Deviating customer terms are not recognized unless we expressly agree to their validity in writing.
§ 2 Conclusion of Contract
Our product presentations in the shop are non-binding invitations to submit an offer. By placing an order, you submit a binding purchase offer. The contract is concluded when we confirm your order by email or ship the goods. We reserve the right to refuse orders without stating reasons.
§ 3 Prices and Payment
All prices are in euros, including statutory VAT. Shipping costs are shown separately at checkout. For deliveries to Switzerland, additional customs duties and import fees may apply, which are to be borne by the buyer. We accept the payment methods displayed at checkout.
§ 4 Delivery
Unless otherwise stated, the delivery time is 1–3 working days within Germany and 3–5 working days to Switzerland. The risk of loss transfers to the customer upon handover of the goods to the shipping service provider. We are not liable for delays caused by shipping service providers, customs clearance, or force majeure.
§ 5 Right of Withdrawal
Consumers have the right to withdraw from this contract within 14 days without giving reasons. The withdrawal period begins on the day you or a third party named by you took possession of the goods. To withdraw, a clear declaration by email to hello@atelier-merkando.com is sufficient. In the event of withdrawal, you bear the direct costs of returning the goods. Refunds will be made within 14 days of receipt of your declaration of withdrawal.
§ 6 Condition of Goods
Our products are restored vintage chairs. Each piece is unique with individual patina and grain. Deviations in color, surface, and appearance compared to the product photos are due to the material and do not constitute a defect. Each chair is photographed individually. The product photos show the specific item you will receive.
§ 7 Warranty
The statutory warranty rights according to §§ 434 et seq. BGB apply. The warranty period is two years from delivery. For vintage products: natural signs of age, traces of use, and material-specific characteristics do not constitute defects within the meaning of warranty law.
§ 8 Retention of Title
The delivered goods remain our property until full payment has been received.
§ 9 Intellectual Property
All contents of the shop — texts, images, logo, and design — are protected by copyright. Any use without our express written consent is not permitted.
§ 10 Data Protection

§ 11 Applicable Law and Jurisdiction
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction for all disputes with merchants is Gießen. For consumers residing in the EU, the mandatory consumer law of the respective country of residence also applies.
§ 12 Dispute Resolution
The EU Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr. We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
